Road Home

For Las Vegas widow Naomi, memories of a Pennsylvania Dutch childhood are an ache from the distant past, a painful memory of abandoned roots and lost connections. She has long since reconciled herself to the shattered dreams that had enticed her from her heritage and now simply lives in a tiny apartment, thick with loneliness and regret. Her sole consolation is her daughter-in-law Ruth. But when hard living claims both of her boys, the two women turn Naomi’s creaky Impala eastward in a desperate, last-chance bid for hope and meaning. Thus begins a cross-country odyssey that brings her home to her old farm in Lancaster County–and to the values and rhythms of a life once spurned. Although the East is foreign territory, Ruth also finds a home here among the slow and authentic cadences of Pennsylvania farm country. And she finds love…

The Battle for Las Vegas: The Law Vs. the Mob (True Crime)

From the 1970s through the mid-1980s, the Chicago Outfit dominated organized crime in Las Vegas. Unreported revenue, known as the “skim,” from Outfit-controlled casinos made its way out of Vegas by the bagful, ending up in the coffers of the Windy City crime bosses and their confederates around the Midwest. Los Angeles, California (PRWEB) August 16, 2011

The million dollar lawsuit was filed by the Law Office of Intellectual Property Attorney Robert G. Klein, located at 555 W. 5th Street in Downtown Los Angeles. ?RG? and his legal team (The Hi Fives) are known in the LA legal community for their tenacity and successful prosecutions. From his office perched high above the gritty center of ‘LA Noir’, Klein has a crusading Batman-like reputation for bringing down patent scofflaws and securing justice for his clients.

The lawsuit was filed July 25th, 2011, in Los Angeles, in the United States District Court for the Central District of California – Case #LACV11-6114.

De Cordova says the heart of the lawsuit is the difference between a ?design patent? and a ?utility patent?, like his. A design patent, like the Gordons’, basically gives the holder a license to make an item with a certain look or configuration, and only costs a few hundred dollars from the patent office. The utility patent provides added product protection, but requires a thorough patent search, technical drawings, and prototypes. They are also relatively expensive – usually costing thousands of dollars, as well as ?maintenance? payments at regular intervals. As de Cordova explained, ?Unfortunately, this lawsuit is necessary to answer the question: ‘Which is the real revolutionary, patented sound blocking sleep mask?’ – a title Gordon claims for his Sleep Master. De Cordova illustrated the disagreement with two quotes from Gordon?s websites:

?After extensive research, the inventor of SLEEP MASTER(an insomnia sufferer) couldn’t find a sleep mask that combined the conditions necessary for deep sleep: light elimination and sound reduction…..Thus was born Sleep Master …”

?With its unique all-in-one, patented design (US Patent No D465, 234S), Sleep Master is the only adjustable sleep mask combining total light elimination and built-in sound muffling, the two conditions necessary for deep restful sleep.?

Says de Cordova, “Blocking sound input is very difficult. To make any noticeable difference, it is necessary to have some sort of effective sound barrier material located directly over, or inside, the ears – preferably in both places.” De Cordova says his Dreamcloud (also called the Dreamhelmet) is hand-assembled from 23 pieces of material, including two that block sound. As extra sound-blocking insurance, he includes free foam earplugs in the Dreamcloud’s secret ‘HiPockets’.

Regarding the lawsuit claims against Sleep Master: patent infringement, false advertising, and unfair competition, de Cordova was philosophical: ?Some say getting a patent is a waste of time and money – that you?re better off to just get out there and start selling whatever you want and make as much money as possible. If lawsuits come up, then just use some of the profits to pay for them, as part of the cost of doing business. Call me old fashioned, because I still have faith in patents and the justice system. But, as they say in Vegas, ‘Going to court is like rolling the dice.’; so after we have our day in court, I might need to adjust my thinking.?

De Cordova originally created his Dreamcloud for adventure travelers. As a combination travelers? sleep tool it was an instant hit with travel experts, such as KC Summers of The Washington Post, and Arthur Frommer of Frommer’s Budget Travel Guide, who both published glowing articles. Frommer called the mask ” ..an ingenious new invention”, and The Post said it was ?..worth its weight in psychotropic drugs.? It has appeared on television numerous times, including Good Morning America, and was even submitted to the Armed Forces for consideration as a tool to help American soldiers sleep in the barracks and battlefield locations. The Dreamcloud website has for years offered free camouflage Dreamhelmets to soldiers on active duty, with any order.

The Dreamhelmet (American flag model, Stars & Stripes) was offered to the US Soccer Team on their way to the 2010 FIFA Finals in South Africa as a way, in de Cordova’s words, “..to help them sleep their way to victory.” (They didn’t take the Dreamhelmets – and they didn’t take the World Cup). “Maybe just a coincidence.” joked de Cordova.

The versatile Dreamcloud is a combination sleep mask and sound muffling pillow. It also has secret patented ?HiPockets? for storing credit cards, money, and jewelry. One pocket was recently enlarged to hold cell phones and iPods, which can be inserted in the pocket and set for a personal wake-up call. The Dreamcloud is clothed in several attractive fabrics, but only 100% cotton touches the face on the inside. Dreamclouds also convert to simple rectangular pillows or hand warming muffs. Some Dreamcloud models are: Cloud Nine, Teddybear, Adventurer, Rainforest, and Blue Heaven. The newest model, Dreamcatcher, in dark blue suede-like material, is sold on both eBay and Amazon. All styles can be purchased by calling (888) 918-5630, or on company websites at http://www.dreamhelmet.com and http://www.sleepmaskpillow.com – the price is $ 29.95 plus shipping.

————————————————————————————————————————

So it’s been a while since I’ve been on Flickr. I haven’t posted anything in the last 10 months. I haven’t been checking my Flickr mail, so there are people that have written to me and I have not responded. A few people have contacted my daughter, MommyWags, to see if I was okay. It’s nice to know I was missed and I apologize to everyone I didn’t respond to.

When I was last posting photos with any regularity, I was on a 7-week motorcycle trip around the United States.

While I was in Florida I started feeling a little bit under the weather. I assumed it was because of the 100°F temperatures with 100% humidity and tried not to pay too much attention to it. We have single-digit humidity where I live. I didn’t feel well all through the South and was looking forward to the low-humidity deserts. I reached the deserts and the temperatures went up into the 110°s and 120°s, but the humidity was low and that made it bearable. I still didn’t feel good and assumed it was the heat.

After reaching home, the first week I thought I was recuperating from being on the road so long. I had pretty much lost interest in everything during the rest and recuperation. However, a week, then two weeks, then three weeks went by and I never fully recovered from the trip.

I was getting numbness in my hands and feet. The symptoms that caused the most problems for me were dizziness, numbness, fatigue, slowed thinking, decreased concentration, decreased memory, blah, blah, blah. The mental symptoms were the hardest for me to deal with. People made jokes about memory problems and getting older, which got really irritating, but I reminded myself that it is ignorance and not malice, and tried to manage a laugh. Some forgetfulness comes from age, but not things like forgetting my kids’ names or forgetting common words in the middle of a sentence. I was having word problems leading to sentences like, "I’m going to go have another fish of coffee." Fish? Where the hell did that come from? I knew the word "cup" and what it meant, but how did "fish" get inserted into the sentence? Bizarre, how the mind works.

I started going through the approximately 8,000 photos I took during the trip when my computer died. That put a damper on my Internet access for a month or two. I managed to save everything from the old hard drive, but my photo software was no longer working. I had a program that used my GPS tracks to geotag my photos. I had another that renamed my photos to yyyymmdd_nnn (year month day sequential) format. My favorite quick edit software came with my camera and I have no idea where the CD is. Etc., etc., etc.

Eventually, I got another computer and got things mostly back to normal. But I missed my power tools.

After procrastinating a long time, I finally went to the doctor to see why I wasn’t recovering from the cross-country trip. I got poked and prodded and bled and x-rayed and hooked to test equipment and everything showed there was nothing wrong with me. Eventually a neurologist determined that I have multiple sclerosis. Oh, shit! When I started reading up on it, I found it’s not as scary as I thought it was. The neurologist also thought there were other things going on and the combination of things made diagnosis difficult.

I am still going to the doctor regularly and trying to figure out what is wrong with me. There comes a point where you don’t really care what is wrong, you just want to know what it is so you can deal with it and go on with life. Even bad news would be better than no news.

Just when you start to think that things can’t get any worse, someone proves you wrong. On New Year’s Eve, I was served with a summons saying I was being sued in federal court in Nevada for posting an excerpt and link to story in the Las Vegas Review-Journal newspaper. The people suing me wanted 0,000 and my domain name! Righthaven LLC is a group of lawyers that got the bright idea they could scour the Internet looking for things they could claim were copyright infringements, buy the copyrights from the newspaper, then sue the blogger for 0,000 as allowed by copyright law. Since it is prohibitively expensive to defend yourself in court, most people—primarily individuals and mom-and-pop businesses—had no choice but to settle for about ,000. Quick and easy money for a Copyright Troll. They’ve filed almost 300 lawsuits so far.

It’s an amazing story. You can read more about it at RighthavenLawsuits.com.

Fortunately, federal judges in Colorado (where Righthaven also partnered up with the Denver Post) and Nevada have seen through Righthaven’s tactics and realized that it is all a scam to use the courts as their personal ATMs. The judges have either put the lawsuits on hold (Colorado) or outright dismissed them (Nevada). Instead of protecting copyrights, Righthaven has succeeded in watering down copyright law, so newspapers now have less protection than before. The Nevada judges are considering sanctioning Righthaven and all the lawyers that participated in the scam. The Nevada state bar is also investigating the lawyers. Karma can be a real bitch!

So there you have it. In the past 10 months I haven’t been doing much of anything. I don’t even get out of the house much any more and that limits my photography opportunities. But I’m hoping that can all start changing and things can get back to semi-normality.

I have a lot of catching up to do on Flickr.
